Employment Tribunal Fees


The Ministry of Justice has published tribunal statistics from April to June 2014 and the statistics show a significant decline in the number of employment tribunal claims received.

The number of single claims received by employment tribunals in this period was 3,792 which is 70% fewer that in the same period in 2013 and a third lower than January to March 2014. This drop in claims from January to March 2014 can be attributed to the introduction of mandatory ACAS early conciliation.

You may recall that UNISON (UK Trade Union) lodged an application in the High Court for judicial review into the introduction of employment tribunal fees in 2014 (R (unison) v Lord Chancellor and another [2014]) and the application was dismissed on the basis that the case had been brought prematurely.

On 18th September 2014, UNISON applied to admit new evidence (given that the requirement to pay fees is now in force) at an appeal hearing against the dismissal of its judicial review application challenging employment tribunal fees.

It has been reported that the Court of Appeal has decided to stay these proceedings while UNISON bring fresh judicial review proceedings in the High Court with their new application relying on the most recent statistics showing a substantial drop in the number of employment tribunal cases.
