SHARED PARENTAL LEAVE UPDATE

The new statutory provisions in relation to Shared Parental Leave came into force on 1st December 2014.

By way of reminder, the provisions apply in relation to children whose expected week of childbirth begins on or after 5th April 2015 or who are placed for adoption on or after 5th April 2015.

The new scheme will make up to 50 weeks of Shared Parental Leave and 37 weeks of Statutory Shared Parental Pay available for eligible parents to take or share. That is everything other than the 2 week compulsory maternity leave period or 2 week period in adoption cases. A mother or primary adopter will be able to end their maternity or adoption leave and share the untaken leave with the other parent as Shared Parental Leave. This can be taken consecutively or concurrently subject to the maximum entitlement.

Shared Parental Leave is optional and parents will not be obliged to take this leave once the new scheme comes into force.

The government has published an employer guide on the gov.uk website and ACAS also have information available on their website.
